Minimum Qualifications

MINIMUM QUALIFICATIONS:

Reassignment: Candidates must have one year of permanent non-competitive service as an Investigative Specialist 2 (Professional Conduct).

Promotion: Candidates must have one year of permanent non-competitive service as an Investigative Specialist 1.

Non-Competitive Appointment: Candidates must have seven years of experience in conducting field investigations or investigations of medical misconduct preliminary to civil litigation or criminal prosecution. This experience must include conducting interviews of witnesses and others; preparing detailed reports of investigative findings; and testifying at administrative or criminal proceedings. One year of the experience must have been at a supervisory level.

Substitutions: An associate’s degree in Criminal Justice or related field may substitute for two years of qualifying experience. A bachelor’s degree in Criminal Justice or a related field may substitute for four years of qualifying experience. Related fields include: law enforcement, police science, criminal justice administration, criminology, criminal investigation, police studies, public justice, forensic accounting, forensic psychology, forensic science, and economic crime management. Duties Description

The New York State Education Department’s Office of Adult Career and Continuing Education Services (ACCES) is seeking candidates to fill an Investigative Specialist 2 position in the Bureau of Proprietary School Supervision (BPSS) New York City office. Under the direct supervision of the Director of Proprietary School Supervision, the incumbent will work in a team environment with staff in both the New York City and Albany offices. The incumbent will supervise the investigations unit, which investigates complaints and possible violations of Education Law and Commissioner’s Regulations for the over 420 licensed private career schools. Duties of this position include, but are not limited to, the following:

• Use a variety of investigative techniques, including gathering and verifying information, interviewing witnesses and complainants, reviewing electronic and paper documents, and conducting surveillance and undercover activities to obtain information and evidence;

• Prepare written reports of the findings, which may be used by agency management and law enforcement in support or defense of administrative, civil or criminal charges, the imposition of fines, penalties or other sanctions, and the negotiation of settlements;

• Supervise Investigative Specialists 1, and other staff as assigned;

• Conduct sensitive or complex investigations requiring greater knowledge and interpretation of the agency’s laws, rules or regulations;

• Plan the scope and method of investigation, and coordinate field activities of assigned staff;

• Coordinate investigations with other agency staff or external entities;

• Review completed investigation reports for adequacy of coverage, quality of findings, and soundness of recommendations and/or make recommendations consistent with findings and agency policy and practice, and the implementation of procedures;

• Prepare periodic status reports for agency program and management staff and perform ongoing evaluations of the needs of the unit;

• Establish and implement investigations unit procedures and protocols;

• Serve as a member of the Bureau’s leadership team in the development of policy guidance; and

• Provide guidance and assistance to Investigative Specialists 1 in gathering and evaluating information and evidence, and discuss the progress of cases with staff to ensure that the performance standards are being met.

Additional Comments

CONDITIONS OF EMPLOYMENT: This will be a permanent, non-competitive appointment. Promotions and transfers may change appointees’ negotiating unit. Applicants should be aware that changes in negotiating units may affect their salary, insurance, and other benefits. Verification of degree will be required for all candidates at the time of interview. Regular statewide travel is a requirement of this position.

*Leads to a maximum salary of $90,876 based on annual performance advances.

**Plus $3,026 annual Downstate location adjustment.
