Profile

Represents the Commission in cases before administrative law judges in Austin and other geographical venues in Texas. The cases consist of Employee Misconduct Registry hearings and due process hearings for Adult Protective Services findings of abuse and neglect in facilities. Work involves handling all aspects of legal representation in administrative hearings and taking appropriate measures to ensure the timely and appropriate resolution of those cases. The position interacts routinely with caseworkers, supervisors, program directors, and program administrators; state office program and field operations staff; agency attorneys, opposing counsel, and administrative law judges; protective services clients, witnesses, expert witnesses, and community professionals; as well as the general public.

Essential Job Functions:

(1) Reviews assigned cases to assess evidence, strengths, and weaknesses of case, and formulates strategies for cases. (20%) (2) Prepares cases for an administrative hearing, including identification and preparation of witnesses. (20%) (3) Researches law, drafts pleadings, and conducts and responds to discovery to develop effective legal strategies and to prepare for administrative hearings. (20%) (4) Represents agency in Employee Misconduct Registry cases before administrative law judges and Adult Protective Services (APS) abuse and neglect cases before SOAH. (20%) (5) Other duties as assigned and required to maintain unit operations, including backup support for APS policy issues, acting in a legal advisory capacity for APS staff, and providing legal training to APS staff. (20%) (6) Promotes and demonstrates appropriate respect for cultural diversity among coworkers and all work-related contacts. (7) Attends work regularly in accordance with agency leave policy.

Knowledge Skills Abilities:

(1) Knowledge and experience of Chapter 48 of the Human Resources Code and Employee Misconduct Registry cases. (2) Knowledge and experience of administrative law and elder law. (3) Ability to handle a high volume caseload. (4) Ability to synthesize law, administrative rules, and agency policies and goals, in formulation of legal arguments and contested case trial strategies to effectively present the Commission’s position before an administrative law judge. (5) Ability to communicate orally and in writing, including the ability to convey complex ideas and instructions clearly to staff. (6) The ability to work closely and productively with regional, state office, and executive staff.

Registration or Licensure Requirements:

Current license to practice law in the State of Texas.

Initial Selection Criteria:

(1) Graduation from an accredited law school. (2) Two years of experience in the practice of administrative law, elder law, and/or litigation related to abuse/neglect/exploitation of a vulnerable population.
